The Brain Injury Law Group has created a Case Development program that helps clients receive the best in both medical and legal expertise. Working with the group’s legal nurse, the attorneys develop a case by exploring the Whole Person:

They explore medical effects of the brain injury that may be occurring throughout the client’s body. For example, a fall leading to a brain injury may also lead to a broken hip, or to long-term neurological effects. A blow to the head might lead to a delayed loss of vision, or a “mysterious” onset of mood swings.

And they examine legal effects of the original brain injury. What damages should be sought for the related symptoms? Are there third parties who should be held responsible for the injury. Who will be responsible for a client’s life care – for his or her ability to receive necessary medical, occupational and psychological care?

What sets the Brain Injury Law Group apart from other law teams?

Karen Shelton is one factor. Karen is a Legal Nurse Consultant who earned her B.S. degree from Purdue University and is registered as a nurse (RN) in South Carolina. Karen also holds national certifications in Life Care Planning, Disability Management Services, and Case Management. She brings a broad background of experience working with catastrophically injured clients.

Karen characterized her work as “part nurse, part detective.” As the first point of contact between clients and the Brain Injury Law Group, Karen helps our legal team understand three aspects of every case: what was the mechanism of injury, what medical damages have occurred, and what kind of Life Care Planning will help our client achieve the best recovery.

Case Study

When our client, Jimmy, picked up his daughter one afternoon, he had no way of knowing that a routine traffic accident would completely change his life. But as he drove down a busy North Charleston roadway, Jimmy suddenly confronted a car pulling into his lane from the far right - a car that a good Samaritan had casually waved through without regard for oncoming traffic. Jimmy struck the car at full force and, as a result, his neck snapped forward and back-never making contact with the windshield or steering wheel.

At the accident scene, Jimmy complained of a headache, but made his way home. Within a week, the pain had grown more severe and he visited an emergency room, where a smart doctor ordered a brain scan. The resulting image showed a major hematoma on Jimmy's left frontal lobe - the area of the brain that governs social skills and regulates emotions.
